  • A.      Any worker or representative of workers who believes that a violation of the Act, these rules, license, or registration condi- tions exists, or has occurred with regard to radiological work- ing conditions in which the worker is engaged, may request an inspection of the facility by the Agency. Any request shall be in writing, addressed to the Director, set forth the specific grounds for the request, and be signed by the worker or repre- sentative of the workers. The Agency shall provide a copy to the licensee or registrant no later than at the time of inspection except that, upon the request of the worker, the Agency shall protect the worker’s name and the name of individuals referred

    to in the request to the extent authorized by law, except for good cause shown.

    B.       If, upon receipt of a request for inspection, the Agency’s Director deter mines that there are reasonable grounds to believe that the alleged violation exists or has occurred, the Director shall initiate an inspection as soon as practicable, to determine if the alleged violation exists or has occurred. Inspections performed under this subsection need not be lim- ited to matters referred to in the complaint.

    C.      A licensee or registrant shall not discharge or in any manner discriminate against any worker because the worker has filed any complaint or caused to be instituted any proceeding under these rules or has testified or is about to testify in the instituted proceeding or because the worker exercises on behalf of the worker or others, any option afforded by this Article.
