  • The hearing officer may subpoena any witnesses or documents requested by any party, or upon his own motion.

    1.        The request shall be in writing and shall state the name and address of the witness and the nature of his expected testimony. The nature of the witness’ testimony must be relevant to the issues of the hearing; otherwise the hear- ing officer may deny the request.

    2.        A request for subpoena of documents shall describe the documents in detail and provide the name and address of the custodian of the documents.

    3.        The request for the issuance of a subpoena shall be filed a minimum of three working days before the hearing.

    4.        The Department shall prepare and serve all subpoenas. Service of the subpoena shall be accomplished by certi- fied mail, return receipt requested.
