  • A party to a hearing has the following rights:

    1.        The right to request a postponement of the hearing, as provided in this Article;

    2.        The right to copy, before or during the hearing, any docu- ments in the Department’s file on the appellant, and docu- ments the Department may use at the hearing, except documents shielded by the attorney-client or work-prod- uct privilege, or as otherwise prohibited by federal or state confidentiality laws;

    3.        The right to request a change of hearing officer as pro- vided in A.R.S. § 41-1992(B) and R6-5-7510;

    4.        The right to request subpoenas for witnesses and evi- dence as provided in R6-5-7511;

    5.        The right to present the case in person or through an authorized representative, subject to any limitations pre- scribed in the Rules of the Supreme Court of Arizona, Rule 31(a);

    6.        The right to present evidence and to cross-examine wit- nesses; and

    7.        The right to further appeal, as provided in R6-5-7518 and R6-5-7520, if dissatisfied with an Office of Appeals’ decision.
