Section R4-28-1303. Information Obtained in an Investigation

A. The Department shall ensure that information and documents in open audits and investigations remain confidential. Officers and employees of the Department shall not make confidential information or documents available to anyone other than the Attorney General or the Attorney General’s representative, or authorized employees of the Department, unless the Commis- sioner authorizes disclosure of the information or production of documents as being in the public interest.
B. Upon request, the Department shall disclose the existence of and make available for review audit and investigative files that were closed within five years of the request for the informa- tion, subject to redaction of confidential or privileged informa- tion such as date of birth, social security number, bank and trust account numbers, home address and telephone number of active-status licensees, criminal history reports, attorney-client privileged communications, work product, and information regarding settlement negotiations.
