If the testing results from two certified laboratories differ or certi- fied laboratory results are challenged by a person or state agency that is contracting for agricultural laboratory services, the Director may designate a laboratory to serve as a referee and assist in mak- ing a final determination. If the test results are challenged, the party who loses the dispute shall pay all costs incurred by the referee lab- oratory.
