An Organization shall not disclose information obtained pertaining to the diagnosis, treatment, or health of a member to any person except:

1.        To the extent necessary to carry out this Article;

2.        Upon the express written consent of the member, appli- cant, provider, or Organization, as appropriate; or

3.        Under statute or court order for the production or discov- ery of evidence or as part of a civil or criminal investiga- tion.
