  • A.      The Department shall investigate the nature and scope of the business of any person, firm, corporation, or association when the person, firm, corporation, or association appears to meet the definition of an “employment agent” in A.R.S. § 23-521, but is operating without an employment agent license.

    B.       The Department’s investigation may include requesting writ- ten reports from the person, firm, corporation, or association in question, inspecting relevant records, and securing statements or depositions from witnesses.

    C.      If, after a thorough investigation, the Department determines that the person, firm, corporation, or association is conducting the business of an employment agent in Arizona without an

    employment agent license, the Department shall submit the entire record of its investigation, along with the Department’s findings, to the appropriate law enforcement agency for crimi- nal prosecution in accordance with the provisions of A.R.S. § 23-536.
