Section R2-7-A911. Dismissal Before Hearing

A. The Director may dismiss, upon written determination, an appeal in whole or in part before scheduling a hearing if:
1. The appeal does not state a valid basis for protest;
2. The appeal is untimely as prescribed under R2-7-A905; or
3. The appeal attempts to raise issues not raised in the pro- test.
B. The Director shall notify the interested party, the agency chief procurement officer, and the state procurement administrator in writing of a determination to dismiss an appeal before hear- ing.
