Section R2-5B-102. Applicability

A. The rules in this Subchapter are applicable to covered posi- tions, applicants for covered positions and covered employees in the State Personnel System.
B. Covered service is limited to the following:
1. An employee who was in the state service as either a pro- bationary or permanent status employee, was not required to become at will uncovered in accordance with A.R.S. Title 41, Chapter 4, Article 4, and who does not:
a. Voluntarily elect to become uncovered at will.
b. Voluntarily accept a change in assignment to a posi- tion in the uncovered service.
c. Have a break in service.
2. A newly hired employee who is appointed or a current uncovered employee who voluntarily accepts a change in assignment to:
a. A position in the Arizona Department of Corrections that is classified as a Correctional Officer I, Correc- tional Officer II, Correctional Officer III, or a Com- munity Corrections Officer; or
b. A position in any state agency that requires certifica- tion as a full authority peace officer by the Arizona Peace Officer Standards and Training Board, pro- vided the position is not in the uncovered service.
