Section R18-9-103. Class Exemptions

Class exemptions. In addition to the classes or categories of facili- ties listed in A.R.S. § 49-250(B), the following classes or categories of facilities are exempt from the Aquifer Protection Permit require- ments in Articles 1, 2, and 3 of this Chapter:
1. Facilities that treat, store, or dispose of hazardous waste and have been issued a permit or have interim status, under the Resource Conservation and Recovery Act (P.L. 94-580; 90 Stat. 2796; 42 U.S.C. 6901 et seq., as amended), or have been issued a permit according to the hazardous waste management rules adopted under 18
A.A.C. 8, Article 2;
2. Underground storage tanks that contain a regulated sub- stance as defined in A.R.S. § 49-1001;
3. Facilities for the disposal of solid waste, as defined in
A.R.S. § 49-701.01, that are located in unincorporated areas and receive solid waste from four or fewer house- holds;
4. Land application of biosolids in compliance with 18
A.A.C. 9, Articles 9 and 10.
