  • A.      The following definitions apply to this Section:

    1.        “Cancel” has the same meaning as “cancellation” in R17- 7-206.

    2.        “Suspend” has the same meaning as “suspension” in R17- 7-206.

    B.       A certified individual’s noncompliance with federal or state laws, rules, or the terms and conditions of the authorization agreement between the Department and the authorized third party may result in corrective action.

    C.      The Department shall send a notice of any corrective actions by regular mail to the mailing address provided by the autho- rized third party.

    D.      Corrective actions that the Department may take include pro- bation, suspension, or cancellation of an individual’s certifica- tion based on:

    1.        History of noncompliance,

    2.        Frequency and severity of the violation, or

    3.        Failure to maintain good standing.
