Section R12-1-1203. Procedures for Rulemaking Public Hearings

A.      Hearings on proposed rulemaking by the Agency shall be held before the Director or another person designated by the Direc- tor to act as the hearing officer.

B.       All hearings shall be governed by the Administrative Proce- dure Act, A.R.S. §§ 41-1021, 41-1021.01 through 41-1025, 41-1028, 41-1029, and 41-1031.

C.      The hearing shall be recorded and shall be retained as part of the record of the rulemaking.

D.      A written summary of the comments presented shall be pre- pared along with a written response to the comments by the Agency staff and retained with the record of the rulemaking.

E.       The request for hearing shall identify the rule involved or pro- pose a new rule.
