  • A.      A licensee, registrant, applicant for a license or certificate of registration, or employee of a licensee, registrant, or applicant; or any contractor (including a supplier or consultant), subcon- tractor, or employee of a contractor or subcontractor of any licensee or certificate of registration holder who provides to any licensee, registrant, applicant, contractor, or subcontractor, any components, equipment, materials, or other goods or ser- vices that relate to a licensee’s, registrant’s, or applicant’s activities in this Chapter, shall not:

    1.        Knowingly engage in conduct that violates or will result in a violation by a licensee, registrant, or applicant, of any statute, rule, regulation, or order; or any term, condition, or limitation of any license or registration issued by the Agency; or

    2.        Knowingly submit to the Agency, or a licensee, regis- trant, or applicant, or a licensee’s, registrant’s, or appli- cant’s contractor or subcontractor, information that is incomplete or inaccurate.

    B.       The Board shall impose the applicable civil penalty listed in R12-1-1216 on a person who violates subsection (A)(1) or (A)(2). For this purpose the person is classified as a Division II licensee and the violation is classified as a Severity II viola- tion.

    C.      For the purposes of this Section, “misconduct” means conduct prohibited under subsection (A).

    D.      A person who is not a licensee, registrant, or applicant and knowingly violates a rule for the safe use of radiation sources in 12 A.A.C.1 is subject to the enforcement actions in 12

    A.A.C. 1, Article 12.
