The selective use of advertising media or content in particular com- binations used exclusively for a housing development or site which leads to discriminatory results is a violation of the Act. In determin- ing whether a media advertising campaign is violative of the Fair Housing Act, the Attorney General shall consider the following fac- tors:
1. The use of English media alone or the exclusive use of media catering to the majority population in an area when, in the area, there are also available non-English or other minority media; and
2. The selective use of human models which primarily cater to one racial, sexual, or national origin segment of the population without a complementary advertising cam- paign that is directed at other groups.
